Terms of Service

These Terms of Service (“Terms”) govern your use of RisingTerms (the “Service”), a website and subscription service operated by RisingTerms, China (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

RisingTerms aggregates publicly available posts, launches, repositories and trending searches from third-party sources, extracts names and phrases from their titles, and provides radar pages, keyword alerts, feeds and exports. The Service provides information and signals only; it does not provide professional, legal, financial or investment advice, and we do not guarantee that any term, launch or signal is accurate, complete, current or commercially valuable.

2. Accounts

  • You must provide a valid email address and keep your password confidential. You are responsible for all activity under your account.
  • You must be at least 16 years old, or the age of digital consent in your country, to use the Service.
  • One person per account. Team or shared use requires one account per person unless we agree otherwise in writing.

3. Plans, payment and renewal

  • The Free plan is provided at no cost with the limits shown on the pricing page.
  • Pro plans are billed in advance in US dollars, monthly or yearly, at the prices shown on the pricing page at the time of purchase. Applicable taxes may be added at checkout.
  • Payments are processed by Creem (creem.io). That party is the seller of record for your transaction, handles tax collection and issues receipts and invoices. Your card statement will show their name.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from Dashboard → Billing or through the billing portal link in your receipt; access continues until the end of the period already paid.
  • Refunds and cancellations are governed by our Refund & Cancellation Policy.
  • We may change prices with at least 30 days' notice by email; changes apply from your next renewal.

4. Acceptable use

You agree not to: resell, sublicense or systematically redistribute the Service or its data; scrape or bulk-download the Service other than through the feeds and exports we provide to your plan; interfere with the Service's operation or security; use the Service to send unsolicited messages; or use the Service in violation of applicable law or the rights of third parties.

5. Third-party content and links

Titles, links and counts shown in the Service originate from third-party websites and belong to their respective owners. We link to the original source and do not endorse any third-party content. Trademarks and product names mentioned in radar data are the property of their respective owners and are shown for identification only.

6. Your data and exports

Keywords, alert channels and exports you create remain yours. Data you export under a Pro plan may be used for your own business purposes. Our Privacy Policy explains how we process personal data.

7. Availability and changes

We aim for high availability but the Service is provided “as is” and “as available”. Sources may change, rate-limit or block access at any time, which can reduce coverage. We may modify or discontinue features; if we discontinue a paid feature, you may cancel and request a pro-rated refund of any unused period.

8. Disclaimer of warranties and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law, including statutory consumer rights.

9. Termination

You may delete your account at any time from Dashboard → Settings. We may suspend or terminate accounts that violate these Terms, with notice where practicable. Sections 5, 8, 10 and 11 survive termination.

10. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules, except where mandatory consumer protection law of your country of residence applies. Disputes will be resolved in the courts of Hong Kong unless mandatory law gives you the right to sue in your home jurisdiction.

11. Changes to these Terms

We may update these Terms. Material changes will be announced by email or by a notice in the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
